Fantasy Pool Terms and Conditions

1. Introduction

2. Membership

These Terms and Conditions ("Terms") fully replace all prior terms and conditions. Fantasy Pool ("Fantasy Pool", "we", "us", or "our") is a fantasy sports service providing administrative support tools, oversight, transparency, security, and convenience for participants in private season-long fantasy sports leagues ("Leagues"). These Terms apply to your use of Fantasy Pool (the "Site" or the "Services"). Please read these Terms and our Privacy Policy carefully before using the Service. By accessing and using the Site or Services, you accept and agree to be bound and abide by these Terms.

3. Acceptable Use

Members may not use Fantasy Pool for purposes other than those described above, including but not limited to:

  • As an aid to online gambling, as defined by Canadian and United States law.
  • As an aid to offline gambling.
  • Sale of goods or services.

Using this Site inconsistently with the described purposes is prohibited.

4. Eligibility

To use Fantasy Pool Services, you must be at least eighteen (18) years of age and a resident of Canada or the United States. Members may use Fantasy Pool for purposes outlined in these Terms.

5. Seasons

Fantasy Pool offers different options during different times of the year, based on the sport’s schedule with which a League is affiliated. Specific information regarding the Regular Season and playoff schedules is available at the official websites for each major sport.

6. League Administration

Private League Invitations: The Member who creates the League ("Commissioner") may choose to allow only individuals to whom the Commissioner sends League invitations to join the League.

Public League Invitations: A Commissioner may choose to allow public distribution of a League invitation, allowing anyone who views the invitation to join the League.

League Payment Settings: Commissioners may choose between two League payment options: eCheck Only or Flexible (Credit/Debit Card & eCheck). Each transaction type requires a convenience fee.

Payment Deadlines: Fantasy Pool will define specific dates ("Season Payment Deadlines") after which payments will no longer be accepted until the Post-season.

Late Payments: Commissioners may allow late payments by enabling the feature. Fantasy Pool will charge a penalty fee for late payments.

Payout Rule: Upon League creation, the Commissioner will choose a method by which end-of-season League winnings are allocated. The Payout Rule cannot be changed once a non-Commissioner Member has made a payment.

7. Payments

League Payments: Payments may be made during three phases of each sport’s season: Preseason, Regular Season, and Post-season.

Payment Methods: Members may make payments via eCheck, credit/debit card, or by reallocating Funds that have been allocated to the Member but not yet paid out.

Foreign Currencies: Fantasy Pool deals only in Canadian and United States dollars.

Reversals and Chargebacks: If a Member initiates a reversal or chargeback, Fantasy Pool reserves the right to freeze all Funds until the matter is resolved.

8. Side Stakes

Fantasy Pool allows Members to participate in "Side Stakes," where Members can wager money on head-to-head matchups within their fantasy league. All side stakes are subject to the following conditions:

  • Both participants must agree to the wager.
  • The wager amount is limited to the balance in the Member’s Fantasy Pool account.
  • Side stakes outcomes are determined by the statistical results of the participants' fantasy teams.

9. Side Stake Deposit Fee for Commissioners

Commissioners who create a pool with a minimum of 10 participants will receive a $25 side stake credit when all players have joined the pool on Fantasy Pool and have paid the entry fee. This credit can be used only on side stakes in the pool they are the commissioner of, subject to the following conditions:

  • The side stake credit cannot be withdrawn before it has been placed on a side stake.
  • The side stake must have a determined winner and cannot be a default where both users claim they won and money is returned.
  • Side stakes can be either league-wide or against individual opponents but must have at least two participants.

10. Winnings and Payouts

Allocation of Winnings: Commissioners may allocate League winnings to Members during the Post-season.

Receiving Payouts: Members with positive balances can request a payout via electronic bank transfer, paper check, printable eCheck, Virtual Visa Prepaid Card, or Gift Card Reward.

11. Compliance with Canadian and United States Law

Fantasy Pool is designed to add oversight, transparency, and convenience to fantasy leagues and office pools. Fantasy Pool is not to be used as a tool to aid gambling. Leagues must comply with Canadian and United States law.

12. Additional Obligations

Identity Validation: Members agree to allow Fantasy Pool to make inquiries necessary to validate their identity.

Unauthorized Transactions: Members agree to regularly examine their transaction history and contact Fantasy Pool immediately in case of any unauthorized transactions.

Member Communication: Members agree that they may be contacted via postal mail, email, phone, and postings on the Fantasy Pool website.

13. Restricted Activities

Members agree not to engage in activities including but not limited to providing false information, using another Member’s account, performing acts that enable money laundering, or any actions that violate Canadian or United States law.

14. Termination or Suspension

Fantasy Pool may terminate or suspend your account if you breach these Terms. Upon termination, your right to use the Site and Services will immediately cease.

15. Indemnity

Members agree to indemnify, defend, and hold harmless Fantasy Pool, its affiliates, and their respective officers, directors, employees, and agents from and against any claims arising from their use of the Site or Services.

16. Disclaimer of Warranties

The Services are provided "AS IS" without warranties of any kind.

17. Limitation on Liability

Fantasy Pool is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services.

18. Conflict Resolution

Any disputes arising from these Terms will be resolved through arbitration administered by a recognized arbitration organization in Canada or the United States, depending on the Member’s country of residence.

19. Referrals

Fantasy Pool allows members to refer new users to the service. When a member successfully refers 20 new users, they will receive a free deposit up to a maximum value of $500. The following conditions apply:

  • Referred users must join a pool for the referral to count towards the 20 referrals.
  • The pool that referred users join must have a minimum entry fee of $5.
  • The maximum value of the free deposit awarded is $500.

20. Amendments to Terms

Fantasy Pool reserves the right to amend these Terms at any time by reasonable notice, including posting revised terms on its website. Significant changes, including changes to the referral program, will be communicated to users in advance through email or the Site.

Continued use of the Site and Services following any changes to these Terms constitutes acceptance of those changes.

21. Miscellaneous

Governing Law: These Terms are governed by the laws of Canada and the United States.

Entire Agreement: These Terms constitute the entire agreement between you and Fantasy Pool regarding the Site and Services.
